10 specimen pension clauses for terms of employment

(to be modified according to the circumstances and the wording of the existing terms of employment, eg using the second and not the third person or vice versa)

 

1 (automatic enrolment applies, details to be provided, no other pension arrangements)

x The Employer is required to enrol its employees and other workers automatically into a pension scheme. Details will provided to employees and other workers as required by the law.

 

2 (employee is or may be a member of a qualifying scheme)

x (a) The Employer operates a pension scheme known as the (name) Pension Scheme, which is a qualifying pension scheme that you may join. If you are not or cease to pay contribution to it or it ceases to be a qualifying scheme, the Employer is or will be required to enrol you automatically into a pension scheme, of which details will be provided to you as required by the law.

(b) While you are a member of and pay contributions to the (name) Pension Scheme and it remains a qualifying pension scheme, the Employer will pay to it contributions of [a]% of your basic pay and you will pay contributions of not less than [b]%. If the Employer is required to enrol you automatically into a pension scheme it will cease to be required to pay any contributions to the (name) Pension Scheme and will not be required to pay to the automatic enrolment scheme any contributions in excess of the contributions required by law.

 

3 (employer to contribute to personal pension scheme specified by the employee)

x The Employer and you may agree in writing that you become a member of a registered personal pension scheme selected by you if it is a qualifying pension scheme for automatic enrolment. If no such agreement is made, you cease to contribute to it or it ceases to be a qualifying scheme, the Employer will be required to enrol you automatically into a pension scheme, of which details will be provided to you as required by the law.

(b) While you are a member of and pay contribution to your personal pension scheme and it remains a qualifying pension scheme, the Employer will pay to it contributions of [a]% of your basic pay and you will pay contributions of not less than [b]%. If the Employer is required to enrol you automatically into a pension scheme it will cease to be required to pay any contributions to your personal pension scheme and will not be required to pay to the automatic enrolment scheme any contributions in excess of the contributions required by law.
